Speak Excellent English grants to its registered users a non-transferable, non-exclusive, and revocable license to use the Program for the term specified as stated in the Program description. Your use of the program is at your sole risk. The program is provided on an “as is” and “as available” basis. The program is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

The program encourages participants to perform many kinds of simple physical movements for the purpose of improving their English speech skills. These movements are described in the program text and demonstrated in the program videos. You acknowledge that it is your responsibility to judge your physical capabilities for such activities and that you perform them at your own risk.The program will not be responsible or liable for any injury or harm you may sustain as a result of performing any of these physical movements.You expressly waive and release any claim that you may have at any time for injury of any kind against Speak Excellent English, including without limitation its principals, instructors, employees, and affiliates.

You acknowledge that you are participating voluntarily in using our website and the program and that you alone are solely and personally responsible for your results. Each person’s language learning abilities depend on his or her background, dedication, desire, and motivation. Your results may vary and will be based on many factors. We make no guarantees concerning the level of success you may experience and you understand that results will be different for each individual.

We do not warrant that a) the program will function uninterrupted, secure, or be available at any particular time or location; b) any errors or defects will be corrected; c) the program is free of viruses or other harmful components; or d) the results of using the program will meet your requirements.

Fees and Payments

Speak Excellent English will charge an enrollment fee for access to the program and may change the fees charged at any time. When fees are changed, the program will notify you by e-mail, by posting a notice on the website, or by any other reasonable form of notification. The enrollment fee amount available to you will be presented within the program description and at the point of enrollment.

Access to the program will be available for the specific term as stated in the program description upon payment of the enrollment fee. Your access to the course will be terminated at the end of the term in effect at the time of purchase.

All fees and charges incurred in connection with your user name and password are your responsibility. You also are responsible for any expenses incurred to access the program, such as computer and other equipment charges, and fees charged by an Internet access provider or other third-party services.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California and the United States of America, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our program and supersede and replace any prior agreements we might have had between us regarding the program.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
